Relationship between You and EventTure

Welcome to EventTure. By using and accessing to our website (the "Site") and services (the "Services") provided by EventTure, you agree to all of the terms and conditions under Terms of Use, Privacy policy, Cookie policy, and any other rules (hereinafter referred to as the "Terms and Conditions") on the Site.

By using our website, application, or services offered by EventTure (the "Platform") and any other site accessed through the EventTure, Users shall be deemed to have read, understood and agreed to accept the Terms and Conditions are binding upon them.

The material, including without limitation information, data, text, editorial content, design elements, look and feel, formatting, graphics, images, photographs, videos, music, sounds and other content contained in or delivered via the Services or otherwise made available by EventTure in connection with the Services is the "Site Content" (or "Content").

Any material (including the foregoing categories) that you contribute, provide, post or make available using the Services is "Your Content". Your Content that you contribute, provide, post is not owned by EventTure. The content is the sole responsibility of the person who makes it available. We reserve the right to examine contents to determine whether they are illegal or not compliant with our policies. We may also remove or refuse to display any content if we have reasonable grounds to believe that it breaches our regulations or the law.

EventTure is not responsible for site unavailability, delays in updating information, damages arising from any interruptions, delays or defects in connecting to the site caused by the power supply, telephone service or internet malfunction or any other cause beyond the control of EventTure. The user is solely responsible for installing programs and systems designed to ensure security when navigating computer networks as well as adequate protection from viruses and other malicious programs on devices used to access the internet.

Revisions to this Agreement

EventTure has the right to revise and change the provisions of the Terms of Use, Privacy policy, Cookie policy at any time without prior notice. Once posted on the EventTure, the amended the Terms and Conditions shall apply to all Users. Users shall be deemed to accept such revision or change when Users continue to use any service provided by EventTure after any revision or change. Users are advised to pay attention to such revisions or changes at any time.

Update and Interruption of the Services

We are constantly updating and improving our services. We may add or remove features and suspend which may cause the interruption of service.Users may stop using our services during the interruption. EventTure may also stop providing services to users or establish new limits to access the services at any time.

Account Creation

(a) Eligibility: Our Platform is available to anyone who is at least 18 years old. You represent that you are at least 18. If you are 13 or older, you may only use the Services under the supervisions of a parent or legal guardian who manages your use and/or account. Additional eligibility requirements for a particular portion of our Platform may be set by any member who has the ability to moderate or manage that portion of our Platform. For example, the eligibility requirements for a event may be set by the organizers or service providers.

(b) Responibity: You can browse our website without registering for an account. To use many of the Services, you will need to register and create an account with a username, password or other basic information. You must provide us accurate and complete information, and you must update your account information as needed to keep the correctness and completeness of your information. You may not impersonate anyone else, choose a username that may offend someone, or violate any individual’s rights. If you do so, we may suspend or cancel your account. To sign up for an account, you need to be at least 18 years old, or old enough to form a binding contract where you live. If you are 13 or older, you may create or manage your user account under the supervisions of a parent or legal guardian. If necessary, we may ask you for proof of age.

(c) Linked Accounts The Services may provide, or Users may provide, links to other external websites or resources. Because EventTure has no control over such websites and resources, you acknowledge and agree that EventTure is not responsible for the availability of such websites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, services or other materials on or available from such websites or resources, or any damages or losses related thereto, even if such websites or resources are connected with EventTure partners or third party service providers.

(d) Suspension of Account: We may modify, suspend or terminate your account or access to the Platform if, in our sole discretion, we determine that you have violated any of the rules, policies or guidelines that are part of the Terms and Conditions. We also may remove accounts of members who are inactive for an extended period of time. A member who has the ability to moderate or manage a particular portion of our Platform also has the ability, in his or her sole discretion, to modify, suspend, or terminate your access to that portion of the Platform.

(e) Account information and Security When you register, you provide us with some basic information, including an email address and a password. It is recommended to keep your email address and other account information current and accurate. You have responsible for all the activity on your account, and for keeping your password confidential. If you find out that someone’s used your account without your permission, you should report it to [email protected] immediately.

Your Content and Privacy

(a) Copyrights: You are solely responsible for your Content. We use the word “Content” to mean any information, material, or other content posted to our Platform or otherwise provide to us (such as feedback, comments, or suggestions shared with us). You agree that you and your Content shall not violate the rights of any third party (such as copyrights, trademarks, contract rights, privacy rights, or publicity rights).

(b) Content License from You: We do not claim ownership of your Content. However, to enable us to operate, improve, promote, and protect EventTure and our Platform, and to ensure we do not violate any rights you may have in your Content, you hereby grant EventTure a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license (including a waiver of any moral rights) to use, host, store, reproduce, modify, publish, publicly display, publicly perform, distribute, and create derivative works of, your Content.

(c) Privacy: EventTure collects registration and other information about you through our Platform. Please refer to our Privacy Policy and Cookie Policy for details on how we collect, use, and disclose this information. These policies do not govern use of information that you provide to third parties, such as other members of EventTure’s Platform.

By using our services, the user agrees that Evensi can use this information in accordance with our privacy policy. We are in no way liable for data provided by copyright holders and/or produced by them and placed online. If a user believes that someone is violating his/her copyright and wishes to report it, he/she should contact directly those who allegedly committed those violations.

Indemnification

You shall defend, indemnify, and hold harmless Odigo, its affiliates and each of its and its affiliates' employees, contractors, directors, suppliers and representatives from all losses, costs, actions, claims, damages, expenses (including reasonable legal costs) or liabilities, that arise from or relate to your use or misuse of, or access to, the Site, Service, Content, Add-to Link or otherwise from your User Submissions, violation of these Terms of Use, or infringement by you, or any third party using the your account, of any intellectual property or other right of any person or entity (save to the extent that a court of competent jurisdiction holds that such claim arose due to an act or omission of Odigo). Odigo reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Odigo in asserting any available defenses.

Termination

We have the right to monitor, terminate, suspend, or delete any User Account at any time for any reason, or no reason.

All provisions of these Terms that by their nature should survive termination of these Terms will survive (including, without limitation, all limitations on liability, releases, indemnification obligations, disclaimers of warranties, agreements to arbitrate, choices of law and judicial forum and intellectual property protections and licenses).

Release

When you use the Services, you release EventTure from claims, damages, and demands of every kind - known or unknown, suspected or unsuspected, disclosed or undisclosed - arising out of or in any way related to such disputes and the Services. All Content that you access or use through the Services is entirely at your own risk and you are solely responsible for any resulting damage or loss to any party.

Warranty Disclaimer

To the extent permitted by applicable laws, the Services are provided on an "as is" and "as available" basis. EventTure expressly disclaims all warranties of any kind, express or implied, including, but not limited to, implied warranties of merchantability, title, non-infringement and fitness for a particular purpose. For example, EventTure makes no warranty that (a) the Services (or any portion of the Services) will meet your requirements or expectations; (b) the Services will be uninterrupted, timely, secure, or error-free; or (c) the results that may be obtained from the use of the Services will be accurate or reliable.

You acknowledge that EventTure has no control over and does not guarantee the quality, safety, accuracy or legality of any event or Content associated with an event, the truth or accuracy of any information provided by Users (including the Consumer's personal information shared with Organizers in connection with events) or the ability of any User to perform or actually complete a transaction. EventTure has no responsibility to you for, and hereby disclaims all liability arising from, the acts or omissions of any third parties EventTure requires to provide the Services or an Organizer chooses to assist with an event.

You understand and agree that some events may carry inherent risk, and by participating in those events, you choose to assume those risks voluntarily. For example, some events may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those events.

The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights. However, the duration of statutorily required warranties, if any, will be limited to the maximum extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, in no event will EventTure, its directors, employees, partners, suppliers, or content providers be liable for any indirect, incidental, punitive, consequential, special, or exemplary damages of any kind, including but not limited to damages (i) resulting from your access to, use of, or inability to access or use the Services; (ii) any indirect, incidental, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, opportunity costs, intangible losses, or the cost of substitute services; or (iii) for any conduct of content of any third party on the Site. The total of such liability shall be limited in aggregate to ten US dollars.

Nothing in these Terms is intended to exclude or limit any condition, warranty, right or liability which may not be lawfully excluded or limited. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by willful acts, negligence, breach of contract or breach of implied terms, or incidental or consequential damages. Accordingly, only those liability and other limitations which are lawful in your jurisdiction (if any) will apply to you and our liability is limited to the maximum extent permitted by law.

Intellectual Property

(a) Yours Content : EventTure does not make any claim to doesn't own content you submit to us (your "Content"). The content is the sole responsibility of the person who makes it available. Miscellaneous

(a) Assignment: These Terms of Use are personal to you, and you can't assign them, transfer them, or sublicense them unless you get EventTure's prior written consent. EventTure has the right to assign, transfer, or delegate any of its rights and obligations under these Terms without your consent. EventTure will provide you notice via email, written notice, or by conspicuously posting the notice on our Site.

(b) No Agency: No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship between you and EventTure is intended or created by this Agreement. A member of the Site is not EventTure's representative or agent, and may not enter into an agreement on EventTure’s behalf.

(c) Government Laws: This Agreement and the relationship between you and EventTure shall be governed by the laws.

(d) No Waiver: A party’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision and does not waive any right to act with respect to subsequent or similar breaches.

(e) Severance: If any provision of these Terms is found to be invalid under the law, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise will remain in full force and effect and enforceable. The failure of either you or EventTure to exercise any right provided for in these Terms in any way won’t be deemed a waiver of any other rights.
